These Terms of Service ("Terms") govern your access to and use of the website and services provided by Drift Automotive LLC ("Drift," "we," "us," or "our") at https://www.sellwithdrift.com (the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms. If you do not agree, you may not use the Platform.
The Platform is a software-as-a-service (SaaS) solution designed for automotive retail salespersons to list marketable inventory, communicate with customers, and grow their personal brand online. Access to the Platform requires account registration and payment of a monthly subscription fee.

Content on the Platform, including text, images, and other materials, may be owned by you, other users, or third parties. By submitting content (e.g., reviews, comments, uploads, or other inputs) to the Platform, you grant Drift a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute such content for the purpose of operating and promoting the Platform. You represent that you have the right to grant this license.
Access to the Platform requires a monthly subscription, processed via our third-party payment processor, Stripe. You agree to:
Failure to pay subscription fees may result in suspension or termination of your account.
All subscription fees are non-refundable. We do not provide refunds or credits for any partial months of service, unused time, or charges already processed, even if you cancel your subscription mid-period. Refunds will not be issued after a subscription charge has been processed.
To officially cancel your Drift subscription, please email your cancellation request to support@sellwithdrift.com. You also have the option to cancel your subscription at any time in the "Settings" page on the Drift web portal.
You agree to respect the intellectual property rights of Drift and third parties. We handle claims of copyright infringement under the Digital Millennium Copyright Act (DMCA) on a case-by-case basis, in compliance with local, state, and federal laws. You may cancel your subscription at any time by sending a written cancellation notice via email to support@sellwithdrift.com or through the "Settings" page on the Drift web portal.
Immediate Termination Upon Cancellation: Drift is a high-value software-as-a-service (SaaS) platform that provides immediate access to premium features including automated Facebook Marketplace posting, AI-powered tools, inventory management, and lead generation capabilities. Upon cancellation of your subscription—whether initiated by you or by Drift—your access to the Platform will terminate immediately, regardless of when the cancellation occurs within your billing period.
There is no grace period, partial-month access, or prorated service after cancellation. This policy applies to all cancellations, including those made immediately after signup. As stated in our No-Refund Policy, all subscription fees are non-refundable, and you will not receive credits or refunds for any unused time in your billing period.
Upon termination, your access to the Platform will cease immediately, and we may delete your data in accordance with our Privacy Policy.
The Platform is provided "as is" and "as available," without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Platform will be uninterrupted, error-free, or secure.
To the fullest extent permitted by law, Drift shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Platform, including but not limited to loss of data, profits, or business opportunities. Our total liability shall not exceed the amount paid by you for the Platform in the preceding twelve (12) months.
These Terms are governed by the laws of the State of Texas, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Dallas County, Texas.
We may update these Terms to reflect changes in our services or legal requirements. We will notify you of material changes via email. Your continued use of the Platform after such changes constitutes acceptance of the revised Terms.
